| spelling | ir-123456789-38222026-06-24T12:20:55Z (184) نظرة عاجلة على قانون العمل الموحد مع بيان لاتفاقيات العمل الدولية التيأنضمت إليها الجمهورية العربية المتحدة A quick look at the Unified Labor Law with a statement of the international labor agreements to which the United Arab Republic has acceded سلامة, أنور عبدالغني العمل الموحد الاتفاقيات الدولية التشريعات النساء، عمل العقود الجماعية 18ص ورقى يتناول هذا البحث دراسة تحليلية لقانون العمل الموحد في الجمهورية العربية المتحدة وعلاقته باتفاقيات العمل الدولية التي انضمت إليها الدولة، وذلك في إطار الجهود الرامية إلى تحديث التشريعات العمالية بما يتوافق مع التطورات الاقتصادية والاجتماعية ومتطلبات العدالة الاجتماعية. ويستعرض البحث الخلفية التاريخية لتشريعات العمل في مصر، موضحًا أن القوانين السابقة كانت موزعة على عدد من التشريعات التي صدرت في فترات مختلفة، الأمر الذي استدعى توحيدها في إطار قانون شامل يضم الأحكام الأساسية المنظمة لعلاقات العمل. ويركز البحث على المبادئ التي استند إليها القانون الموحد، وفي مقدمتها تحقيق التوازن بين حقوق العمال وأصحاب الأعمال، وضمان المساواة في شروط العمل داخل المهنة الواحدة، والمحافظة على الحقوق المكتسبة التي وفرتها التشريعات السابقة مع تطويرها بما يتناسب مع ظروف العصر. كما يناقش البحث أثر الاتفاقيات الدولية للعمل في صياغة التشريع الوطني، مبينًا أهمية التزام الدولة بالمعايير الدولية المتعلقة بساعات العمل والأجور وشروط السلامة المهنية والضمانات الاجتماعية وحقوق التنظيم النقابي. ويتناول كذلك الأحكام الرئيسية للقانون فيما يتعلق بعقود العمل، وتشغيل العمال، والتدريب المهني، وتسوية المنازعات العمالية، وحماية العمال من الفصل التعسفي، وتنظيم العلاقة بين أطراف الإنتاج. ويبرز البحث دور التشريع العمالي في دعم التنمية الاقتصادية والاجتماعية من خلال توفير بيئة عمل مستقرة وعادلة تسهم في رفع الإنتاجية وتعزيز الاستقرار الصناعي. كما يناقش التحديات المرتبطة بتطبيق القانون ومدى الحاجة إلى التوفيق بين متطلبات التنمية الاقتصادية وحماية حقوق العاملين. ويخلص البحث إلى أن توحيد تشريعات العمل يمثل خطوة مهمة نحو تطوير النظام القانوني للعمل وتحقيق قدر أكبر من الوضوح والاستقرار في العلاقات العمالية، وأن الالتزام بالاتفاقيات الدولية يعزز من فعالية التشريعات الوطنية ويرسخ مبادئ العدالة الاجتماعية وحقوق العمل بما يواكب التطورات الاقتصادية والاجتماعية الحديثة. This study provides an analytical review of the Unified Labor Law in the United Arab Republic and its relationship to the international labor conventions adopted by the state. The research is situated within the broader effort to modernize labor legislation and align national labor policies with evolving economic, social, and international standards. The paper reviews the historical development of labor legislation in Egypt, noting that labor regulations had previously been dispersed across several laws enacted at different times, creating the need for a comprehensive and unified legal framework governing employment relations. The study examines the fundamental principles underlying the Unified Labor Law, including the promotion of fairness between employers and workers, the establishment of equal working conditions within the same occupation, and the preservation of workers’ acquired rights while adapting labor regulations to contemporary socioeconomic conditions. Particular attention is given to the influence of international labor conventions on national legislation. The paper highlights the importance of compliance with international standards concerning wages, working hours, occupational safety, social protection, freedom of association, and collective labor rights. It further discusses the principal provisions of the law relating to employment contracts, labor recruitment, vocational training, dispute settlement procedures, protection against unjust dismissal, and the regulation of relations between workers and employers. The study emphasizes the role of labor legislation in promoting economic and social development by creating a stable and equitable work environment that enhances productivity and industrial harmony. It also addresses challenges associated with implementing labor laws, particularly the need to balance economic development objectives with the protection of workers’ rights and welfare. The research concludes that the unification of labor legislation represents a significant step toward improving the legal framework governing employment relations and strengthening legal clarity and consistency.
